Procedure

Client:

It will be considered a client who, in his own name or on behalf of third parties, carries out a reservation management of a property marketed by Construcciones Hermanos Agüero S, l in his name or through any of the commercial denominations of his property such as Navstarota, either through the web, email, telephone or any other channel of real estate supply.

Payment of the Service:

1º) Reservation of the property; The amount of 20% applicable on the total (taxes and fees included) is established as Reservation. The necessary data for its realization by the client will be collected in the Reservation Acceptance document issued by Navstarota.

The client has a period of 24 hours from receipt of the Reservation Acceptance document issued by Navstarota to make the deposit, deposit or transfer in favor of Navstarota.

After the above-mentioned term of 24 hours and NOT having produced the confirmation by Navstarota of the receipt of the amount as 20% of the total, the reservation will be considered as not realized on the part of the client being able to attend other requests of reservation on the mentioned property.

2º) Remaining payment: 80% will be paid by the client in the same act of handing over the keys of the property. Please do not forget to send Navstarota the proof of payment for the Reservation, as well as your personal data (Name and Surname, ID or Passport, Full Address, Telephone and email)

Reservation Cancellation Policy:

100% refund seven days before the rental period between October 1 and February 28.
0% refund less than seven days before the rental period between October 1 and February 28.
100% refund one month before the rental period between March 1 and September 30 (except July and August).
0% refund less than one month before the rental period between March 1 and September 30 (except July and August).
100% refund forty-five days before the rental period between July 1 and August 31.
0% refund less than forty-five days before the rental period between July 1 and August 31.

Early termination of the rental period by the Client: In the event that the client ends the rental period of the property early, he will not have any right to economic compensation or a possible change of future dates for the enjoyment of the period not consumed.

Responsibilities

-Responsibility of the Client for damages caused during the occupation of the property.
Once the apartment has been received, the client assumes full responsibility for his actions and those of the guests who occupy the property reflected in the reservation document during the selected period.

Before the effective occupation of the property occurs, the client will have the power to visually inspect all the services that the property has, as well as to check the perfect condition of the belongings, appliances, internet connection, or even parking if applicable. For the
consolidation of possible damages that may occur during the stay, the client will provide the bank details reflected in a Debit or Credit card of his ownership, these being the card number, and the date ofadducity. Navstarota will proceed to block as a deposit of an amount of One

Hundred Fifty Euros (€ 150.00) which will be released once the apartment has been reviewed in a maximum of 48 hours.

In the event of any damage to the content or continent of the properties owned or managed in any aspect by Construcciones Hermanos. Agüero S, l, this will charge the bank account owned
by the client associated with the bank card for the total amount of the damage.
Construcciones Hermanos Agüero reserves the right to take legal action if it deems appropriate for the damages that have occurred, operating damages, interests or any other.

-Deposit. In order to constitute the corresponding Deposit with which to attend to the damages that may be caused by the client, guests and / or third parties who can access the property with
their consent, the client AUTHORIZES the capture by electronic means of the corresponding debit / credit card that facilitates for this purpose.

Check-in hours and key handover:
The time of entry and key handover will be from 16:00 pm until 20:00 pm.

Check-out and key return times:
The time of departure and return of keys: It will be before 12:00 am reflected as the day of end of stay in the property.

In case of exceeding the established time as departure from the property, it will be considered sufficient reason for Navstarota to make an additional charge.

Key drop-off or return location:
The location where the keys will be handed over by Navstarota, as well as the collection thereof, will be reflected in the Reservation Confirmation document, which may be in the same
property or in the offices owned by Navstarota.

Rules of Use.

Number of guests: The maximum number of occupants staying in the property will be reflected in the reservation request document made by the client and accepted by Navstarota.

Pets: Pets of any kind are not allowed without exception, unless specified in the characteristics of the property.

Rules of coexistence:

  • It is strictly forbidden to hold parties.
  • It is strictly forbidden any activity in the common areas of the buildings that supposes an alteration of the rest of the occupants of the building such as Shouting, Playing, Singing etc.,
  • It is not allowed to deposit personal belongings of any kind in the common areas of the buildings.
  • It is not allowed to deposit garbage bags in the common areas of the buildings.
  • Smoking is not allowed, although in buildings that have a garden, terraces or patios if it will be allowed in the aforementioned dependencies.
  • It is not allowed to park or deposit objects in the common areas of the garages such as bicycles, motorcycles, cars, etc.,
  • Please use the space specifically located to dry clothes, do not deposit them on the terraces or balconies.

In some cases, the properties are integrated into residential buildings, respect the res schedules, as well as the specific community rules of each of them.

Cleaning: The property will be made available to the client in the proper conditions of cleaning.
The client undertakes to leave the apartment in a reasonable cleaning condition withoutgarbage or food remains.

To take into account.

  • Specific conditions of the apartment: In addition to the general conditions, we strongly request that you check the specific conditions of the contracted apartment.
  • Photos and description of the apartment: In Navstarota we verify the apartments and provide the client with a detailed description and updated images so that he knows all the
    details of the accommodation. However, it is possible that there is some variation with the decoration and equipment of the contracted property.
  • Overbooking: In the event of a double reservation simultaneously for the same apartment, in this case, Navstarota will provide the client with an alternative accommodation of equal or superior quality.
  • Damage or problems before the start of the rental period: In the event of any breakdown or damage to the apartment that does not allow you to stay, Navstarota will provide you with an alternative accommodation of equal or superior quality.
  • Damage or problems in the apartment during the rental period: We work to provide you with the best quality in your accommodation, in case you have any problems, please call Navstarota for a prompt solution as soon as possible.
  • Responsibility: Navstarota is NOT responsible for any loss or damage caused to the of the tenant´s belongings deposited in the property or in its annexes such as garage, common spaces, etc., during their stay for any reason or concept.

Data protection policy

The client, by providing their personal data in the reservation form, whether it is done through the web, e-mail, telephone or any other means during the reservation process, implicitly expressly and unequivocally consents to be incorporated into the personal data file that Construcciones Hermanos Agüero, S.L. has to be able to meet its obligations regarding the provision of the contracted rental service. These data will be used and processed for the purpose, in the manner and with the limitations established in Regulation (EU) 2016/679, of
April 27 (GDPR) in Organic Law 3/2018, December 5th (LOPDGDD), on the Protection of Personal Data and its regulatory development, and the owner of the personal data may freely exercise the rights of access, rectification, cancellation and opposition of their data and the
revocation of their consent, in the terms provided by the same Law 3/2018, December 5th, through the email info@navstarota.com

It is possible that the accommodation is owned by PPREVISIÓN DE VIVIENDAS PARA EL SOCIO S, L in these cases your data will be communicated to the aforementioned entity that
owns the selected accommodation in order to formalize the reservation of the same and invoice the stay or by legal obligation

With the exception of the above, your data will not be communicated to other third parties. If for any reason it is necessary to communicate such data to third parties, you will be informed in advance and the corresponding steps will be taken to do so. Except in the cases in which a legal requirement obliges to communicate said data to a third party.

Applicable law and competent jurisdiction

These terms and conditions of contract are governed by Spanish Law. Construcciones Hermanos Agüero, S.L. and the Client, for the resolution of any dispute that may arise, with respect to its validity, execution, compliance or resolution, total or partial, submit, expressly
waiving their own jurisdiction or any other that, where appropriate, may correspond to them, to the jurisdiction of the courts and tribunals of Rota (Cádiz).
